These Terms of Use (the "Terms") govern your access to and use of the roam your way travel planning app, available at roamyourway.app and as an iOS application (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
These Terms together with the Privacy Policy form a legally binding agreement between you and the operator of the Service (defined below).
The Service is provided by Roam Your Way, registered with the Dutch Chamber of Commerce (KvK) under number 42057065, based in the Netherlands ("we", "us", "our"). For all queries about these Terms, contact:
We aim to respond to all enquiries within a reasonable time, and within statutory deadlines where applicable.
You must be at least 16 years old to create an account and use the Service. By using the Service, you represent that:
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
You create an account through Sign in with Google or Sign in with Apple. After the OAuth handshake with Google or Apple, our authentication layer (Supabase Auth) issues a session token that keeps you signed in across the Service. We do not operate a separate username + password login: you always sign in via Google or Apple, and we receive only the identity information described in our Privacy Policy (your name, email, and — with Google — profile photo).
You are responsible for safeguarding access to the Google or Apple account you use to sign in. We are not liable for any loss or damage arising from unauthorised access caused by compromise of those upstream accounts.
You may have only one account per natural person. We may suspend duplicate accounts.

The Service is provided for personal, non-commercial use. You may not resell, sublicense, or commercially exploit any part of the Service or its outputs without our prior written consent.

We may change the features included in each tier from time to time, including the precise per-tier limits, on reasonable notice. Material reductions in paid functionality will be communicated in advance and will entitle you to cancel in line with Section 9.
The Service uses third-party large language models (currently Anthropic's Claude API) to:
AI output is informational only.
Despite our best efforts, AI-generated content may be incomplete, outdated, inaccurate, or unavailable when you act on it. Specifically:
To the maximum extent permitted by law, we are not liable for travel disruption, missed connections, refused entry, financial loss, or other consequences arising from reliance on AI-generated content. Your statutory consumer rights under EU/Dutch law are not affected by this clause.
"User Content" means any data, text, links, images, itineraries, notes, comments, trip details, forwarded emails or other material you submit to the Service.
You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, process, transmit, display and modify your User Content solely for the purpose of operating, improving and supporting the Service for you (including AI processing, sharing with collaborators you invite, transmission to third-party processors listed in the Privacy Policy, and backup). This licence ends when you delete the relevant User Content or your account, subject to short backup-retention windows and to records we are legally required to keep.
You represent and warrant that you have the rights necessary to submit your User Content and that doing so does not infringe any third party's rights or any law.
We do not use your User Content to train AI models. Anthropic, our AI provider, contractually does not train on data submitted via its API.
Billing. Pro subscriptions are billed in advance, either monthly or annually depending on the plan you choose at checkout. Prices are inclusive of any applicable VAT charged at the rate of your billing country.
Renewal. Subscriptions auto-renew at the end of each billing term (monthly or yearly) unless cancelled before the renewal date. You can cancel from your account settings in the Service (or, for App Store purchases, through your Apple ID subscription settings).
Refunds — EU right of withdrawal. Where you are an EU/EEA consumer, you have a right to withdraw from a paid subscription within 14 days of purchase under the Consumer Rights Directive. Because Pro is a digital service that begins immediately on purchase, you expressly consent (by completing the upgrade) to immediate performance and acknowledge that you lose the right of withdrawal once the service has been fully performed. In practice we will refund any unused portion of the first 14 days on request.
Refunds — App Store. Subscriptions purchased via the iOS App Store are governed by Apple's refund process. We do not control App Store refunds.
Failed payment. If a payment fails and is not corrected within 7 days, your account may be downgraded to the Free tier. Your data is retained.
Price changes. We may change subscription prices on at least 30 days' notice. Price changes take effect at the next renewal; you may cancel without penalty before then.

When you invite another person to view or collaborate on a trip, you confirm that you have a basis to share their email address with us for that purpose. Invited collaborators see the trip data you share with them, can edit it (if invited as collaborators), and may add their own User Content. You remain responsible for what you share.
If a collaborator removes themselves or you revoke their access, their derivative copies (e.g. screenshots, downloads) are not within our control.
The Service relies on third-party providers (Google, Apple, Anthropic, Supabase, Resend, Postmark, Vercel, Open-Meteo, Pexels, Unsplash and the relevant push-notification services). These providers are subject to their own terms and privacy policies, which you accept by using the relevant features. The full list and links are in our Privacy Policy.
We are not responsible for content, availability, or actions of third-party services, including any external links surfaced inside generated itineraries.
The Service — including the roam your way name, logo, design, code, copy, and proprietary features — is owned by us or our licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for the duration of your account, solely as permitted by these Terms.
Nothing in these Terms transfers any ownership of the Service or its components to you.
You may delete your account at any time from your account settings. Account deletion removes your User Content from our systems within 30 days, subject to backup-retention windows and any records we are legally required to keep.
We may suspend or terminate your account if:
Where reasonable and permitted, we will give you advance notice and an opportunity to remedy the breach.
We aim to keep the Service available, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific feature will remain available. We may take down parts of the Service for maintenance, security, or to roll out improvements.
We reserve the right to modify, suspend, or discontinue the Service (or any feature) at any time, with reasonable notice where this materially affects you.
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. AI-generated outputs in particular are not warranted to be accurate, complete or current. Your statutory consumer rights under EU/Dutch law are not affected by this clause.
To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the Service is limited to:
We are not liable for any indirect, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, travel costs, alternative-arrangement costs, or missed connections, whether arising from contract, tort, statute or otherwise.

To the extent permitted by law, you agree to indemnify and hold us harmless from any third-party claim arising out of:
This indemnity does not apply to claims caused by our own breach, negligence, or wilful misconduct, and does not apply where you are acting as a consumer to the extent that local law prohibits such an obligation.
We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent change. For material changes that affect your rights, we will notify you in-app, by email, or by push notification before the changes take effect.
If you do not agree to the updated Terms, you must stop using the Service and may delete your account. Continued use of the Service after the effective date of the changes constitutes acceptance.
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.
If you are a consumer ordinarily resident in another EU/EEA Member State, you also benefit from the mandatory consumer-protection provisions of your country of residence.
Disputes arising out of or in connection with these Terms will be brought before the competent courts of the Netherlands, except that consumers may also bring proceedings in the courts of their country of residence as required by law.
EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
We are not liable for any failure or delay in performance caused by events outside our reasonable control, including natural disasters, war, civil unrest, government action, internet or hosting outages, or third-party service failures.
If any part of these Terms is found unenforceable, the rest will continue in full force. These Terms (together with the Privacy Policy and any plan-specific terms presented at the point of upgrade) form the entire agreement between you and us regarding the Service and supersede any prior arrangement.
